To satisfy Swiss legal requirements, temporary or permanent staff recruited through an agency has to be hired hired through a Swiss company, which has the necessary licenses to do so.
Hiring or leasing staff through non-Swiss companies or Swiss companies that do not have the necessary licenses is not compliant with Swiss law and can inflict in penalties even for the client.
To be allowed to provide services in this area, one or more of the following licences are necessary:
The permits and licences of SDE.
Cantonal employment agency licence
This licence - ususally covering certain professions - allows the employment of indiviuals with Swiss nationality or other nationality in case valid Swiss work and residency permits are already existing.
Federal employment agency licence
Allows the employment of foreigners of the specified profession, who are coming to Switzerland for the first time or of individuals, who spent time in other countries and therefore do not have a valid Swiss work and residency permit.
Cantonal licence for placement of permanent staff
This licence is needed if a permanent placement of an individual of a certain profession with Swiss nationality or another individual with valid work and residency permits is made.
Federal licence for placement of permanent staff
As for the employment agency licence a federal licence is needed if permanent placements for individuals of a certain profession without valid Swiss work and residency permits are made.
